Discrimination on the Basis of Religious Beliefs and Affiliations

Employers in California may not treat their employees or prospective employees more or less favorably because of their religious beliefs, practices or affiliations. Certain exceptions may be made when accommodations are warranted. Other incidences of religious discrimination include:

  • Refusing to hire members of a certain religion
  • Forcing employees to participate or not participate in a religious activity
  • Not accommodating employees' religious practices, unless doing so would present an undue hardship for the employer
  • Not permitting employees to engage in religious expression, unless doing so would present an undue hardship for the employer
  • Imposing stricter promotion, compensation or other work requirements on members of a certain religion

Employers are not required to accommodate their employees' religious practices if they can show that doing so would create an undue hardship for the business. If the religious practice (s) are prohibitively expensive, will diminish efficiency, will infringe upon other employees' rights, will impair workplace safety or will conflict with another law, the employer has the right to refuse to accommodate them.

Employers must also take the necessary steps to prevent religious harassment and hostile work environments and to allow for the reporting and investigation of harassment should it occur.
