Fight Back Against Religious Discrimination

It is unlawful for employers to discriminate against their employees because of their religion or religious beliefs. Decisions about hiring, termination, performance, compensation and other issues of employment must not be made on the basis of religion or those employers may be liable for employment litigation. It is the right of every individual to follow the religion of their choice, without having to worry about what affect those beliefs will have upon their employment and livelihood.

The Rutten Law Firm, APC is committed to preserving and protecting the rights of individuals in the workplace and our experienced attorneys provide counsel and representation in cases of religious discrimination. We have helped many of our clients resolve their cases favorably and have obtained compensation for their lost wages, emotional distress and other damages. If you have been negatively affected by religious discrimination at your place of employment, it is in your best interest to consult with a lawyer as soon as possible.

Discrimination on the Basis of Religious Beliefs and Affiliations

Employers in California may not treat their employees or prospective employees more or less favorably because of their religious beliefs, practices or affiliations. Certain exceptions may be made when accommodations are warranted. Other incidences of religious discrimination include:

  • Refusing to hire members of a certain religion
  • Forcing employees to participate or not participate in a religious activity
  • Not accommodating employees' religious practices, unless doing so would present an undue hardship for the employer
  • Not permitting employees to engage in religious expression, unless doing so would present an undue hardship for the employer
  • Imposing stricter promotion, compensation or other work requirements on members of a certain religion

Employers are not required to accommodate their employees' religious practices if they can show that doing so would create an undue hardship for the business. If the religious practice (s) are prohibitively expensive, will diminish efficiency, will infringe upon other employees' rights, will impair workplace safety or will conflict with another law, the employer has the right to refuse to accommodate them.

Employers must also take the necessary steps to prevent religious harassment and hostile work environments and to allow for the reporting and investigation of harassment should it occur.
